The parish council owns and operates a small cemetery in Churchfoot Lane between Wonston and Droop. This is a wonderful, tranquil spot and plots for burials and cremated remains can be purchased.

 The current fees and Regulations are shown below:

CEMETERY REGULATIONS wef 1st OCTOBER 2021

1. Introduction: The Cemetery will be managed by Hazelbury Bryan Parish Council (HBPC) to comply with the Local Government Act 1972 and the Local Authorities Cemeteries Order 1977 and any further relevant legislation.

2. Access: Access is freely available. Children under the age of 10 years of age should be accompanied by an adult. Dogs are not allowed unless on a lead.

3. Interments: These will normally be allowed between the hours of 9.30 am to 5.30 pm, Monday to Friday, unless approved otherwise.

4. Fees: All fees due must be paid before any interment

5. Documentation: All necessary forms such as the Registrar’s certificate for disposal or a Coroner’s order after an inquest shall be produced before the interment.

6. Officiating: Aside from marking any grave space, HBPC will have no role to play in any interment. HBPC will have no responsibility for organising any aspect of any funeral.

7. Exclusive Right of Burial (ERB): An ERB in respect of a grave space may be purchased for a period of 99 years. On payment of the correct fee at the date of grant of the ERB, a certificate will be issued to the applicant.

At the discretion of HBPC, an ERB may be surrendered by the owner and a refund made of the original fee

 

8. Graves: Responsibility for safely preparing graves rests entirely with the Funeral Director appointed by the representatives of the deceased.

For a coffin interment the minimum depth of the grave will be 6 feet 6 inches and the minimum distance of the top of a coffin to the surface shall be 3 feet. Burial of a second coffin in a grave where there has already been an interment is allowed provided that a layer of soil at least 6 inches deep is provided between the two coffins. The maximum dimensions of a grave space shall be 8 feet by 3 feet maximum.

For cremated remains, the distance from the top of any casket to the surface shall be 2 feet 6 inches. The maximum dimensions of a space for cremated remains shall be 18 inches by 18 inches.

As soon as practicable after burial, the grassed portion of each grave shall be levelled. Fences or enclosures, stones and chippings etc are not permitted on graves. The only ornaments permitted are memorials in accordance with paragraph 9 below, and a single pot or vase containing a small plant or cut flowers.

HBPC may remove any articles placed or planted on graves which are not permitted by these Regulations or which have become broken or unsightly.

9. Memorials: All memorials installed in the Cemetery must confirm to the current guidelines of the National Association of Memorial Masons. No memorial may be erected unless an ERB has been purchased. No memorial may be erected unless and until permission has been granted by HBPC. A drawing showing the form, dimensions and material of each memorial and the proposed inscription shall be submitted to HBPC for approval.

Memorials on grave spaces for coffin burial shall not exceed 3 feet in height, 2 feet 4 inches in width and 1 foot 4 inches from front to back.

Memorials on cremated remains plots may only be tablets or plaques of a maximum size of 15 inches by 15 inches.

It is the responsibility of the owner of the memorial to maintain it in a good state of repair. HBPC reserves the right to take down any memorial which, in the opinion of HBPC, has become unsafe. HBPC may temporarily take down any memorial which may be rendered unsafe or dangerous during the excavation of an adjoining grave.

10. Floral tributes etc: Vases and other containers for flowers shall be of a suitable and durable material to the satisfaction of HBPC. Graves will be tidied and floral tributes, both real and artificial, may be removed by HBPC when dead or unsightly. Planting of trees on grave spaces is prohibited. HBPC will prune or remove any shrub, plant or flower whenever, in the opinion of HBPC, it has become unsightly or overgrown or where necessary for the purpose of allowing any other grave to be used.

11. Seats, benches etc: No seat or bench shall be placed in the Cemetery without the written permission of HBPC. Lights, candles, artificial decorations which detract from the rural, tranquil nature of the Cemetery will not be allowed and may be removed by HBPC.

12. Residency: The Cemetery is primarily intended to be used by residents of Hazelbury Bryan or those with a strong family or historic connection to the community. Charges are based on residency of the deceased (in the case of interments and memorials) or the purchaser (in the case of an ERB). Where the death of the person takes place within three years of ceasing to be a resident of the parish, or the person dies in a care home or hospital outside the parish but whose last place of residence was within the parish they will be regarded as residents for the purpose of the fees to be charged.

For all those deemed to be non-resident, all fees will be doubled.

The decision of HBPC as to whether a person is resident or not shall be final.

13. Disclaimer: HBPC cannot be held responsible for any damage to any memorial or personal property taken into the Cemetery. HBPC will not be liable for any damage to any memorial in the Cemetery caused by storm, wind, subsidence or any other cause.

If any damage is caused to HBPC’s land or premises by bringing in any equipment, materials, gravestones, monument of any other cause the person or persons doing such damage will be held responsible for the same and HBPC may recover the cost or repairing such damage from such person or persons and in addition take proceedings under Article 18 of the Local Authorities’ Cemeteries Order 1977.

HBPC reserves the right to make alterations to these regulations and fees from time to time.

14. Approval: These regulations were approved by HBPC at a meeting of the parish council held on 13th April 2021 and will take effect from 1st October 2021.
